Terms of Service.

These Terms govern your access to and use of powertopractice.com.au (the "Site") and any products, training, content or services we provide. By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

About us

The Site is operated by Power to Practice, a Western Australia-based distributor of medical aesthetic devices and skin technologies. References to "we", "us" or "our" mean Power to Practice. References to "you" mean the visitor or user accessing the Site.

Who the Site is for

Most public-facing pages of the Site are intended for visiting members of the public, clinic owners and healthcare practitioners seeking general information about the products we distribute. Certain content — including practitioner-only product information for therapeutic goods regulated under the Therapeutic Goods Act 1989 (Cth) — is gated behind verified practitioner login and is intended only for registered Australian healthcare practitioners.

By accessing gated practitioner content, you confirm that you are a registered Australian healthcare practitioner and that the AHPRA registration details you provided are true and current.

Information accuracy

We take reasonable care to ensure information on the Site is accurate and up to date. However, the Site is provided for general information only. Product specifications, regulatory references, treatment protocols and pricing are subject to change, and current versions are available from our team on request.

Nothing on the Site constitutes medical advice, prescribing guidance, or a recommendation that any product is suitable for a particular patient. Healthcare practitioners must rely on the manufacturer's Instructions for Use, their own clinical judgement, and applicable regulatory requirements when treating patients.

Acceptable use

You agree not to use the Site:

  • In any way that breaches Australian or international law.
  • To send or facilitate spam, malware, or unauthorised commercial communications.
  • To attempt to gain unauthorised access to gated practitioner content, our systems, or the systems of any third party.
  • To copy, reproduce, scrape or republish any content from the Site for commercial purposes without our written consent.
  • To impersonate any person, including by submitting false AHPRA registration details to access HCP-only information.

We may suspend or terminate your access to the Site at any time, without notice, if we reasonably believe you have breached these Terms.

Intellectual property

All content on the Site — including text, layout, graphics, logos, photography and trade marks — is owned by Power to Practice or used under licence from manufacturers and other rights holders. You may view and print pages for personal or clinic-internal reference. You may not otherwise reproduce, modify, distribute or display any content without our prior written consent.

Product names, including MonaLisa and Octave, are used to describe the products we distribute on behalf of their respective manufacturers and remain the property of those manufacturers.

Orders and supply

Submitting an enquiry through the Site does not constitute an order or contract for supply. All orders are subject to a separate written stockist or supply agreement, which sets out pricing, minimum order quantities, training, service and warranty terms specific to each product.

Where we supply therapeutic goods, supply is conducted in accordance with the Therapeutic Goods Act 1989 (Cth) and applicable state and territory laws. Some products may only be supplied to verified Australian healthcare practitioners.

Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy implied or imposed by the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) which cannot be lawfully excluded.

To the extent permitted by law, our liability for breach of any consumer guarantee in respect of services we supply is limited to (at our option) supplying the services again or paying the cost of having the services supplied again. Our liability for breach of any consumer guarantee in respect of goods is limited to (at our option) replacement of the goods, repair of the goods, payment of the cost of replacement or repair, or refund of the price paid.

Limitation of liability

To the maximum extent permitted by law, and subject to the Australian Consumer Law section above:

  • We do not warrant that the Site will be uninterrupted, error-free, or free from harmful components.
  • We are not liable for any indirect, consequential, incidental or special loss or damage, including loss of profits, loss of revenue, loss of business opportunity, loss of data or loss of goodwill, arising out of or in connection with your use of the Site.
  • Our total aggregate liability arising out of or in connection with the Site (other than in respect of consumer guarantees) is limited to AU$100.

Third-party links and content

The Site may include links to manufacturer websites, regulatory authorities (such as the TGA and AHPRA) and third-party services. We provide these links for convenience only. We are not responsible for the content, privacy practices or terms of any third-party website, and inclusion of a link does not imply endorsement.

Indemnity

You agree to indemnify and hold us harmless from any claim, loss, damage, cost or expense (including reasonable legal costs) arising out of or in connection with your breach of these Terms, your unlawful use of the Site, or your misrepresentation of any registration or credential information.

Privacy

Our collection, use and disclosure of personal information is governed by our Privacy Policy, available at powertopractice.com.au/legal/privacy. By using the Site, you consent to the handling of your personal information in accordance with that Policy.

Governing law and jurisdiction

These Terms and any matter arising in connection with them are governed by the laws of Western Australia and the Commonwealth of Australia. The parties submit to the exclusive jurisdiction of the courts of Western Australia and any courts competent to hear appeals from those courts.

Changes to these Terms

We may update these Terms from time to time. The current version is always available at powertopractice.com.au/legal/terms. The Effective date at the top of this page indicates when the Terms were last updated. Continued use of the Site after an update constitutes acceptance of the revised Terms.
